Terms of Service

These Terms govern your use of Localfy. Please read them carefully.

These Terms govern your access to and use of Localfy’s services, apps, and websites (“Service”). By using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1) Accounts & Eligibility

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for safeguarding your credentials and all activity under your account.
  • The Service is intended for business use; you must be at least the age of majority in your jurisdiction.

2) Platform Access & Permissions

You authorize Localfy to access and act on your connected social accounts strictly as you configure (e.g., posting, analytics, and engagement tools). You can disconnect at any time. You remain responsible for the content posted to your Pages/accounts.

3) Your Content & License to Us

You retain ownership of content you provide. You grant Localfy a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and transmit your content as needed to operate the Service, including to publish to your connected accounts at your direction.

You represent that you have all rights necessary to upload, schedule, and publish the content you provide.

4) Acceptable Use

  • No illegal, infringing, deceptive, or discriminatory content.
  • Do not abuse or interfere with the Service, attempt to bypass security, or scrape data.
  • Comply with all third-party platform policies (e.g., Meta/Facebook/Instagram).

5) Subscriptions, Billing & Refunds

  • Plans renew automatically unless canceled. You can cancel anytime effective at the end of the current billing period.
  • Fees are non-refundable for the current period once charged, except where required by law.
  • We may change prices with reasonable notice effective on your next billing cycle.

6) Privacy

Our Privacy Policy explains how we collect and use information. By using the Service, you consent to such processing.

7) Copyright & Complaints

If you believe content published through the Service infringes your rights, contact us at legal@localfy.me with details. We may remove or disable access to content and notify the account owner.

8) Service Changes & Availability

We may modify or discontinue features with reasonable notice where practical. We are not liable for platform outages, API limits, or changes by third-party platforms that affect the Service.

9) Suspension & Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or applicable law. Upon termination, your license to use the Service ends and we may delete your data per our retention policies (see Privacy Policy).

10) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCALFY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES.

12) Indemnification

You agree to indemnify and hold Localfy and its affiliates harmless from claims arising out of your content or your use of the Service in violation of these Terms or applicable law.

13) Governing Law; Dispute Resolution

These Terms are governed by the laws of your principal place of business in the United States, without regard to conflict-of-laws rules. Courts located there will have exclusive jurisdiction for any disputes not subject to arbitration where applicable law permits.

14) Changes to Terms

We may update these Terms. Material changes will be communicated in-app or by email. Continued use of the Service after changes become effective constitutes acceptance.
